Terms, waiver & media release

In consideration of being allowed to participate in any class, program, or event provided by Runqiao Du, LLC, I understand and expressly assume all risks involved in dance instruction, rehearsal, training, and performance, whether in person or through remote learning over the internet. These risks include serious bodily injury and death, and include injury resulting from contact with other students, instructors, walls, equipment, floors, structural poles, and other objects located in or near dance studios or in any location where dance instruction, rehearsal, training, or performance is taking place, and injury resulting from my own physical condition or limitations. I warrant that I am physically fit and able to participate. If I participate remotely, I am solely responsible for my practice space, including adequate room, safe flooring, and suitable footwear, which Runqiao Du, LLC cannot observe or control.

On behalf of myself, my child or children, and our heirs, executors, administrators, estates, and assigns, I irrevocably release, waive, discharge, indemnify, and hold harmless Runqiao Du, LLC, its successors and assigns, and its members, managers, officers, directors, employees, faculty, contractors, and agents (the "Releasees") from any and all claims, demands, suits, actions, causes of action, costs, expenses, losses, awards, judgments, injuries, or damages, including reasonable attorneys' fees and related costs incurred by any Releasee, caused or alleged to have been caused by any Releasee to me or to my child or children in connection with participation in any Runqiao Du, LLC program, including claims arising out of dance instruction, rehearsal, training, and performance, whether caused by ordinary negligence or otherwise, and whether for bodily injury, property damage, loss, or otherwise. This release does not apply to gross negligence, recklessness, or intentional misconduct, or to any liability that cannot be released under applicable law.

If the participant is under 18, I am that participant's parent or legal guardian and I have legal authority to accept this agreement on their behalf. If any part of this release is unenforceable as to the participant, I will indemnify the Releasees against any claim brought by or on behalf of the participant, including a claim brought after the participant reaches the age of majority.

I will disclose any medical condition, injury, allergy, or limitation relevant to safe participation. If the participant is injured or becomes ill and I cannot be reached, I authorize Runqiao Du, LLC to obtain emergency medical care for the participant at my expense.

This agreement is governed by Maryland law and by the dispute resolution and arbitration terms in the Terms of Service. If any part of it is held unenforceable, the remainder stays in effect. It applies to every Runqiao Du, LLC program I or my child participate in, now and in the future, until replaced by a later version. I agree that accepting this electronically has the same legal effect as signing it, and that Runqiao Du, LLC may keep a record of my acceptance.

I have read this waiver, assumption of risk, release, and indemnification. I am at least 18 years old. I understand that I am voluntarily giving up substantial legal rights, on my own behalf and on behalf of any minor participant I register.

I grant Runqiao Du, LLC permission to publish and exhibit images, video, and audio of myself or my child or children, including any video I submit, for promotional, marketing, editorial, and publicity purposes, in any medium, worldwide, without limitation, reservation, prior inspection, or approval. I waive any right to royalties or other compensation arising from or related to that use.

On behalf of myself, my child or children, and our heirs, executors, administrators, and assigns, I release Runqiao Du, LLC, its successors and assigns, and its members, managers, officers, directors, employees, contractors, and agents from any and all claims relating to that use, including but not limited to claims based on libel, invasion of privacy, or violation of any right of publicity. The absence of, or lack of explicit mention of, a specific claim does not limit the extent of the application of this agreement. This consent is perpetual and irrevocable.

I attest that I am at least 18 years of age, and that I accept and agree to the above terms on my own behalf and, if the participant is under 18, as that participant's parent or legal guardian with authority to do so.
